No person that conducted flights before November 17, 2003 under a program that meets the definition of fractional ownership program in § 91.1001 may conduct such flights after February 17, 2005 unless it has obtained management specifications under this subpart.

Research Notes

Section 91.1002 — Compliance date — establishes when Subpart K becomes applicable to an operation that meets the fractional definition.

The trigger: Once an operation meets the fractional ownership definition (multiple program owners, program manager providing aircraft management services), Subpart K's operational requirements apply immediately. There is no grace period for an existing flight department that transitions to a fractional model.

Practical scope: Operators considering moving from traditional Part 91 corporate operations to a fractional model must complete Subpart K compliance build-out before operations begin.
