§ 91.193 Certificate of authorization for certain Category II operations.

The Administrator may issue a certificate of authorization authorizing deviations from the requirements of §§ 91.189, 91.191, and 91.205(f) for the operation of small aircraft identified as Category A aircraft in § 97.3 of this chapter in Category II operations if the Administrator finds that the proposed operation can be safely conducted under the terms of the certificate. Such authorization does not permit operation of the aircraft carrying persons or property for compensation or hire.

Research Notes

Section 91.193 — Certificate of waiver or authorization — provides the FAA's authority to issue waivers from the operating rules of Subpart B when consistent with safety.

What gets waived: The Administrator may waive specific Subpart B rules for special operations — airshows, aerial demonstrations, banner-tow operations, formation flights with passengers, certain agricultural operations, scientific research flights, etc.

Process: The pilot/operator submits FAA Form 7711-2 (Certificate of Waiver or Authorization) describing the proposed operation, the rules to be waived, and the safety mitigations. The FAA evaluates and issues the COA with specific conditions.

Common applications: Aerobatic boxes for airshows, banner tow areas, agricultural application below § 91.119 minimums, formation flights with passengers, certain research operations.
