Section 91.901 establishes the applicability of Subpart J — Waivers. This Subpart provides the framework for the FAA to issue waivers of Part 91 rules when consistent with safety.
The waiver power: The FAA may waive any rule of Part 91 except for those specifically prohibited from waiver. The waiver is issued via a Certificate of Waiver (Form 7711-2) specifying the conditions, duration, and scope of the waiver.
Common waiver categories: Aerobatic boxes (waiving § 91.119 altitude or § 91.303 location), formation flights with passengers (waiving § 91.111(c)), agricultural application at low altitude, demonstration flights, banner tow operations, and similar specialized activities.
